The Court is unnecessarily stuck in a pre-Dobbs framework under which the unborn had no legal rights and seems to be ignoring a long tradition of legal protection for a woman’s unborn descendants, including inheritance rights, Social Security and federal employees’ survivor benefits, and Aid to Families with Dependent Children program.
